Terms of Use (GTC)

General Terms and Conditions for Passenger Transport

1. Scope of Application

These General Terms and Conditions (hereinafter "GTC") apply to all transport services and related services provided by Firma Fly (Ahmad Nabi Azzad), operating as a rental car service (Mietwagenunternehmen) under § 49 of the German Passenger Transport Act (PBefG). By booking a ride, the customer accepts these terms.

2. Conclusion of Contract and Booking

Firma Fly is not a taxi service. According to § 49 PBefG, all rides must be booked in advance via telephone, email, or our website. Spontaneous hailing on the street or at public taxi stands is strictly prohibited by law.

A binding contract is formed only upon explicit confirmation of the booking by Firma Fly.
The customer is responsible for providing accurate details (date, time, pickup location, destination, number of passengers, and luggage).

3. Fares and Payment

Unlike regular taxis, our fares are fixed and agreed upon prior to the journey. The agreed fare is binding and covers the direct transport from the designated pickup point to the destination.

Additional waiting times caused by the customer or extra stops requested during the journey may incur supplementary charges.
Payments can be made in cash directly to the chauffeur or via accepted electronic payment methods at the end of the ride, unless pre-payment was agreed upon.

4. Cancellation Policy

We offer flexible cancellation policies for our clients. However, to ensure operational efficiency, the following rules apply:

Cancellations made up to 24 hours before the scheduled pickup time are generally free of charge.
For cancellations made at very short notice or in the event of a "no-show", Firma Fly reserves the right to charge a cancellation fee up to the full amount of the agreed fare.

5. Passenger Obligations and Conduct

The safety and comfort of all passengers and our chauffeurs are paramount.

All passengers must wear seatbelts in accordance with German traffic laws (StVO).
Smoking, consuming strongly smelling food, and carrying hazardous materials inside the vehicles are strictly prohibited.
The customer is liable for any exceptional contamination or damage to the vehicle caused intentionally or by gross negligence. Firma Fly reserves the right to charge for cleaning or repair costs.

6. Liability Restrictions

Firma Fly is liable in cases of intent or gross negligence in accordance with statutory provisions. For slight negligence, we are only liable in the event of a breach of material contractual obligations (cardinal obligations). Liability for delays caused by force majeure, extreme traffic, or severe weather conditions is excluded.

7. Final Provisions and Jurisdiction

If any provision of these GTC is entirely or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected. These Terms of Use and all legal relations between the customer and Firma Fly are governed exclusively by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes is Cologne (Köln), Germany.
